For Cook, it's more cated. Pennington County Chief Deputy State's Attorney Lara Roetzel said Cook qualifies as a habitual offender, because he was convicted of possession of a controlled substance in 1995, felony drunken driving in 2002 and trafficking in controlled substances in 1997. If Cook is deemed a habitual offender, the maximum penalty for each charge he faces would be increased. Prosecutors argued that, if Cook were convicted of kidnapping, being a habitual offender would make him eligible for the death penalty. He pointed out that Cook's previous felony convictions were not for crimes of violence.
